These Terms of Service govern your access to and use of BannerKraft, including the website, account area, project tools, poster concept generation, projection mode, billing, support, and any related services we provide.
By creating an account, starting a subscription, or using BannerKraft, you agree to these Terms. If you are using BannerKraft for a business, you confirm that you have authority to accept these Terms for that business.
Who we are
BannerKraft is operated from Vancouver, Canada. In these Terms, “BannerKraft”, “we”, “us”, and “our” refer to the BannerKraft service and its operator.
You can contact us at [email protected].
Your account
You must provide accurate account information and keep your login credentials secure. You are responsible for activity that happens through your account, including projects, prompts, generated images, billing activity, and support requests.
If you believe your account has been accessed without permission, contact us promptly.
What BannerKraft does
BannerKraft helps people create poster and banner concept images from project briefs, style notes, and optional reference material. The service can generate concept boards, refine existing concepts, store generated images, and provide projection tools that help you trace or paint a finished poster.
Generated results are produced by AI systems and may be imperfect. You are responsible for reviewing every output before using it, selling it, printing it, projecting it, tracing it, or sharing it with a client.
Your content
“Your content” means the briefs, prompts, project details, style notes, uploaded reference images, generated images, comments, support messages, and other materials you submit to or create with BannerKraft.
You keep whatever rights you already have in your content. You give BannerKraft permission to host, process, transmit, display, store, reproduce, and transform your content as needed to provide, maintain, protect, and improve the service.
You are responsible for making sure you have the rights needed for any names, logos, artwork, images, references, wording, or other material you submit. Do not submit material if you do not have permission to use it.
Generated images
Subject to these Terms, you may use generated images for your personal or commercial poster workflow. This includes using an image as a concept, mockup, client preview, painting reference, or projection reference.
AI-generated images may not be unique. Similar or identical results may be generated for other users, and outputs may not qualify for copyright or other exclusive rights in every jurisdiction. BannerKraft does not promise that generated images are free of third-party rights, suitable for trademark use, or legally protectable.
Before using a generated image commercially, check it for mistakes, unsafe content, unwanted resemblance to real people, brands, copyrighted characters, protected artwork, or other issues that could affect your use.
Acceptable use
You may not use BannerKraft to:
- Break the law or violate another person’s rights.
- Generate or request sexual content involving minors, exploitative content, hateful content, harassment, threats, or instructions for wrongdoing.
- Upload private, sensitive, or confidential information unless you have permission and a real need to use it in the service.
- Impersonate someone else or misrepresent your relationship with a client, brand, business, or organization.
- Infringe copyrights, trademarks, publicity rights, privacy rights, or other intellectual property rights.
- Attack, scrape, probe, overload, reverse engineer, or interfere with BannerKraft or its providers.
- Bypass rate limits, credit limits, billing controls, authentication, security controls, or access restrictions.
- Resell, rent, or provide managed access to BannerKraft as a competing service unless we agree in writing.
We may block, remove, or refuse content, accounts, or activity that we believe violates these Terms or creates legal, security, operational, or abuse risk.
Subscriptions, credits, and billing
Paid plans are billed through Stripe. Plan prices, credit amounts, and included features are shown on the pricing page or in the checkout flow before purchase.
Credits are a service meter for creating and editing poster concepts. Credits are not cash, stored value, or a transferable balance. We may grant, reserve, spend, restore, or expire credits according to the plan, billing state, and product behavior shown in the app.
Subscriptions renew automatically unless cancelled. You can manage billing through the account billing page or by contacting support.
If a payment fails, your access to paid features may be limited until payment succeeds or the plan is changed.
Cancellation and refunds
You can cancel your subscription at any time. Cancellation stops future renewals, but does not automatically refund the current billing period unless required by law.
Unused or consumed credits are generally non-refundable. If a BannerKraft system failure spends credits without producing a usable result, we may restore credits or provide another reasonable fix.
If you believe a charge was made in error, contact [email protected] with the account email and charge details.
Third-party services
BannerKraft relies on third-party providers for parts of the service, including payment processing, email delivery, support chat, hosting, storage, AI model access, logging, and infrastructure.
When you use BannerKraft, your content and account information may be processed by those providers as needed to provide the service. Third-party providers may have their own terms and policies.
Service availability and changes
We aim to keep BannerKraft useful and available, but the service may be interrupted, delayed, changed, limited, or discontinued. AI providers, payment processors, email providers, storage providers, hosting providers, browsers, networks, and other dependencies can affect availability and output quality.
We may change features, limits, prices, plans, providers, or these Terms. If a change materially affects paid use, we will make a reasonable effort to notify you through the app, email, or the website.
Account suspension or termination
We may suspend or terminate access if we believe you violated these Terms, created risk for other users, created security or abuse risk, failed to pay, or used the service in a way that could harm BannerKraft or its providers.
You may stop using BannerKraft at any time. You can request account deletion by contacting [email protected].
Disclaimers
BannerKraft is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, and output accuracy.
We do not provide legal, tax, accounting, design-rights, trademark, or copyright advice. You are responsible for deciding whether generated images and project materials are appropriate for your intended use.
Limitation of liability
To the fullest extent allowed by law, BannerKraft will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, or replacement services.
To the fullest extent allowed by law, our total liability for any claim related to BannerKraft is limited to the amount you paid to BannerKraft in the three months before the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.
Governing law
These Terms are governed by the laws of British Columbia, Canada, and the federal laws of Canada that apply there, without regard to conflict of law rules.
